Appeal Board Panel under Human Organ Transplant Ordinance appointed

The Secretary for Food and Health has appointed nine members to the Appeal Board Panel constituted under section 7I of the Human Organ Transplant Ordinance.
The appointment, which took effect from September 1, 2011 for three years until August 31, 2014, was gazetted today (September 9).

A Government spokesman explained that the Human Organ Transplant Ordinance (Cap. 465), enacted in 1995, is to prohibit commercial dealings in human organs intended for transplanting, to restrict the transplanting of human organs between living persons and the transplanting of imported human organs, and for supplementary purposes connected with those matters.
An exemption mechanism for regulated organ products was provided under the Human Organ Transplant (Amendment) Ordinance 2004, relevant provisions for which came into operation on September 1, 2011. The Panel was set up as part of the mechanism to process appeals against decisions on exemption. More details could be found at http://www.dh.gov.hk/english/useful/hot_exemption.html.
Meanwhile, the spokesman said a number of other related provisions, including the Human Organ Transplant (Amendment) Regulation 2010 and the Human Organ Transplant (Appeal Board) Regulation, also came into effect on September 1, 2011.
The Human Organ Transplant (Amendment) Regulation 2010 is for making technical amendments to the three statutory forms in the Schedule of the Human Organ Transplant Regulation to be used by prescribed persons to supply prescribed information to the Human Organ Transplant Board with respect to removal, transplant and disposal of organs.
The Human Organ Transplant (Appeal Board) Regulation is to provide for the rules and procedures for the making, processing and determination of appeals to the Appeal Board constituted under the Human Organ Transplant Ordinance.
